§ 119-3. Fingerprinting and criminal history review.

  • All applicants, their officers, directors, and shareholders as required to be fingerprinted under Chapter 120, Cabarets, Public Dance Halls, and Catering Establishments, shall submit to fingerprinting by the Police Department. Fingerprint cards shall be forwarded by the Police Department to DCJS, along with the appropriate processing fees as established by DCJS for identification processing. The Police Commissioner or his or her designee shall be responsible for the submission and review of the criminal history record information disseminated by DCJS. The Police Commissioner may refuse to issue or renew a license to an applicant if the applicant, licensee, its officers, principals, directors or stockholders owning more than 10% of the outstanding stock of the corporation have been convicted of any offense which is a felony under the laws of New York or a crime committed in violation of the laws of any other jurisdiction which if committed in New York would be a felony and/or any offense which is a misdemeanor related to and/or involving the premises on or in which the licensed business is to be conducted, unless the disability of such conviction(s) have been removed as provided under Article 23 of the Correction Law.
